Silicon Valley layoffs and support orders: why timing matters in Santa Clara County

Layoffs across Silicon Valley have become a recurring headline, and Silicon Valley tech professionals often feel the impact first. When a job ends or compensation shifts from cash to equity, the financial shock is immediate. Unfortunately, child support and spousal support orders do not automatically adjust when income drops. If you keep paying an amount based on last year’s W-2 while your severance runs out and RSUs stop vesting, arrears can accumulate quickly and interest may follow.

How tech compensation changes can distort support calculations

Support orders are typically based on income at the time of the last court order. In tech, that income may have included bonuses, RSU vesting, ESPP gains or a high base salary that no longer exists. A layoff can also change health insurance costs, childcare expenses and timeshare schedules, all of which can affect guideline child support in California.

Before you assume the court will “understand later,” it helps to know what usually matters most when seeking a modification. The following points are common in San Jose cases involving sudden income changes.

  • The date you file. Courts generally can only modify support back to the date a request is filed, not the date you were laid off. Waiting can mean paying the old amount for months even if you have no paycheck.
  • RSUs and bonuses require careful documentation. A reduction in vesting schedules or a loss of performance bonuses can be a real income change, but the court may require documentation to establish the change such as grant notices, vesting statements, pay stubs and employer communications.
  • Severance and unemployment still count. The court often treats these sources as income for support purposes, so a realistic budget and accurate disclosures are essential.

Taken together, these factors explain why acting quickly and presenting clear evidence can make the difference between a manageable adjustment and a growing arrears balance.

In the current Silicon Valley tech climate, layoffs and reduced equity compensation can turn a reasonable support order into an impossible one overnight. The safest approach is to move quickly, document the change thoroughly, and pursue a formal modification rather than hoping the problem resolves itself. If you are facing a sudden income drop, speaking with a certified California family law specialist attorney can help you evaluate options and avoid preventable arrears.
